# Terms of Use

**Version 0.10 — 16 August 2026**

These terms apply when you use SenSight. They are written to be short and plain.
Where you have signed a separate written agreement with us, that agreement
prevails over these terms.

## 1. Your data is yours

You own everything you upload or create. We claim no ownership of it.

**We never use your data to train machine-learning models.**

You can export your data at any time in open formats (CSV, Excel, HTML) —
including after your subscription ends.

## 2. Where your data is stored

If you use the hosted service, your data is stored on our servers in Australia.
If you run SenSight on your own infrastructure, your data never reaches us.

The application also works offline: much of your work stays in your browser
until you choose to save it.

## 3. Artificial intelligence features

AI features (photo/OCR import, AI report, AI chat, open-ended survey coding)
run on **your own API key** for a third-party AI provider.

When you use your own key, the data you send is handled under **your agreement
with that provider**, not under these terms. We are not a party to it.

AI output is **advisory**. You remain responsible for your engineering and
quality decisions.

## 4. What you may do with the software

You may use SenSight for your own work, for the plan and the number of users you
have paid for. Please do not resell it, or provide it to third parties as a
service, without our written agreement.

## 5. Payment, renewal and cancellation

Paid plans run for the period you selected.

**Monthly and annual subscriptions renew automatically** at the end of each
period, at the price shown when you subscribed, until you cancel. One-off and
"lifetime" purchases do not renew.

You can cancel at any time from **Manage subscription** in the app (or by
emailing us). Cancelling stops future charges; **you keep access until the end
of the period you already paid for**. We do not refund the remaining part of a
period unless the law requires it.

If a renewal payment fails, we retry for a short time and tell you; access ends
if payment is not completed.

A "lifetime" purchase includes updates, and hosting where applicable, for
**five (5) years**. After that you may keep using the version you have.

Prices are in USD. We are **not currently registered for GST**, so prices do
not include GST and we do not issue tax invoices.

## 6. Availability and support

We provide support by email during Australian business hours. We do not
guarantee a specific uptime figure unless we have signed a separate service
level agreement with you.

## 7. Warranty and liability

We take care to make SenSight correct, and its statistical results are validated
against reference implementations. Even so, software can contain errors.

**Australian Consumer Law:** nothing in these terms excludes or limits any
guarantee or right that cannot lawfully be excluded. Where we may limit our
liability, our total liability is limited to the fees you paid us in the
twelve months before the claim, and we are not liable for indirect or
consequential loss such as lost profit or lost production.

## 8. Ending your use

You may stop at any time. We may suspend access if these terms are seriously
breached, after telling you and giving you a reasonable chance to fix it.
Your right to export your data (section 1) continues.

## 9. Changes to these terms

If we change these terms materially, we will publish a new version and ask you
to accept it. Your existing purchase keeps the terms you accepted at the time.

## 10. Law

These terms are governed by the law of New South Wales, Australia.
